各位前辈大家好
最近有收到一个新加坡商的 Remote Offer
但在查看 Offer 后有些疑虑,希望大家能给我一些建议
公司 (大概还算) 是新加坡的新创,2007 年成立
最近打算在台湾成立分公司,
我上经济部商业司的网页查过
看起来的确是有登记过了,登记时间是去年 12 月
工作方式在台湾办公室正式成立前都会是 WFH (电脑可能要先自备)
目前团队在台湾已有 7.8 人的样子
薪资方面大概是我目前年薪的 1.5 倍,因此我基本上很满意
Pay 的发放方式,HR 是说由于台湾这边还没全部到位
因此会先走国际汇款的方式,
劳健保方面目前也都要先自行负责 (差额有另外加在薪资里,年薪约+10%)
比较让我有疑虑的部分是当初我们没有明确讲到合作方式
我一直以为是 Full-Time,但收到 Offer 后才发现是 Contract
我不确定这是不是因为台湾公司还没 Ready 的关系 (当然我自己一定会再去询问为何不
是 FullTime 约)
想先请教各位前辈一下看看这种方式是否会有什么疑虑,因为我从来没有约聘的经验...
合约上面有注明我提供的服务内容是与团队合作进行 Software Design、Develop and
maintain
并没有限定某个专案
Scope of Services ("Services")
You will provide services to XXXXX and its team. Services to be rendered
include:
(a) Design, develop and maintain web applications and back-end services.
(b) ...
(c) ...
计薪方式是每月需发放多少工资 (特别注明已含劳健保相关费用)
This total fee includes salary, national health insurance, national pension,
and labour pension.
再跟 HR 面谈时,HR 是说有关于假期部分就都根据台湾这边的制度 (周休二日、国定假
日) 走
但附录中又有明确写到非雇员不提供休假
This Contract is purely a contract for services and is not a contract for
employment and does not provide for any leave, medical benefits, insurance or other
benefits or the payment of any allowances and Central Provident Fund contributions.
合约中也有压上起讫时间
Contract Term
This Contract is effective for a period of 8 months, commencing from XX April
2022 to 31 December 2022 (both dates inclusive). It will be renewed year-on year until
terminated. This contract will automatically terminate when you are moved to a permanent local
employment agreement.
关于附录中有合约期限的注意事项
Contract Term
This Contract shall commence on and expire on the respective dates as set out
and may be renewed for such further periods mutually agreed in writing.
另外在 Relationship 章节中有特别注明
Your relationship with XXXXX shall be that of an independent contractor and
at no time shall you hold yourself out as being an employee of XXXXX.
看起来就是个约聘约,
但是甲方就是我实际上的工作的公司
不知这样的合约是否有什么需要特别注明的地方?
我自己完全没有经验,希望版上的前辈给我点参考
