因为隐匿掩盖柴油排放造假案，美国有三个州起诉大众相关涉案人士。
包括纽约州、麻州和马里兰州的检察单位，同时起诉大众集团几十人(dozens)，
包括前任CEO Martin Winterkorn、现任CEO Matthias Muller、其他集团高层人士，
以及好几个部门的负责人与造假装置的工程师等人。
纽约州总检察长Eric Schneiderman，批评大众有一种深植在公司傲慢(思维)的企业文化
，这种傲慢让他们心中觉得可以无视法治，可以忽视保护公众健康和环境
他说,“一定要让大众付出钜额罚款，罚款金额要高于它们赔偿给美国消费者的总额。”
Eric Schneiderman, New York Attorney General, said the new claims
“reveal a culture of deeply rooted corporate arrogance, combined with
a conscious disregard for the rule of law or the protection of public health
and the environment. Substantial penalties must be imposed on the Volkswagen
companies, above and beyond the amount they have to pay to make American
consumers whole.”

虽然在事件爆发前，检察官早在去年8月就已经下令不准销毁文件资料，
但至少有八名跟研发造假装置有关的大众工程师仍违法删除或移除罪证资料。
不过，在被删除的文件当中，有一部份资料已经被侦办人员复原救回来了。
检方起诉书的内容显示，大众造假行动有十年以上的时间了。
排气造假，前CEO Winterkorn早就知情，其他还有多名集团高层人士，
像是全球行销总监Christian Klingler、好几个部门的负责人也知情(directors)，
但他们却不去补救改善。

而现任CEO Matthias Muller，虽然检方没有指控他知情，
但他在2006年担任Audi管理高层的时候，就知道有某些柴油排气方面的问题，
他曾做出最终决策，同意某些3.0TDI柴油引擎不要采用更大型的尿素桶，造成容量不足
而他也知道这项决策会影响到3.0TDI在面对美国排气标准时的(环保)效能。
因此很明显的，Muller是决策过程的一份子 (in the loop)。

The suits did not state Muller was aware of the violations.
Schneiderman told reporters Muller "was made aware of some aspects of this
problem" and that "he clearly was in the loop."
The New York suit said current CEO Matthias Muller, then head of project of
management at Audi, and Winterkorn became aware in July 2006 of the effect of
undersized urea tanks on the ability to comply with emissions standards.
The suit said VW opted to install defeat software instead of larger tanks to
save money.
