ITC 337调查：Tela Innovations控告华硕、宏碁、微星、联想、英特尔

加州的专利授权公司Tela Innovations于2018年12月19日，向美国国际贸易委员会（ITC
）要求进行337调查(Docket #3358)，被调查的公司，包括：台湾业者华硕、宏碁、微星
，及中国的联想，还有美国的英特尔，指控这些被告公司输往美国的特定积体电路产品（
Certain Integrated Circuits and Products Containing the Same）侵犯其专利权，因
此Tela请求ITC进行“337调查”，并发布相关禁止令。
这些终端产品业者成为被告的原因，因他们的PC/NB/Tablet产品使用到Intel涉嫌侵权的
处理器， 因而受到牵连。
由于，Tela Innovations是专利授权公司，也就是俗称专利流氓或NPE公司，因而本案可
能进入快审程序。根据美国ITC针对日渐严重的“专利流氓”(Patent Troll)议题提出有
效的解决方案，针对选定某些案件，在立案后100天之内对于某些决定性的问题先进行早
期的裁决(Early ID)，包括早期的听证会，以减少不必要的诉讼，节省诉讼时间和成本。
也就是说，100天内进行早期裁定Early ID，特别对某些选定的提诉公司(原告)，确认其
必须证明在美国有重要的业务存在(domestic industry)、进口事实(importation)以及具
有起诉身份之立场(standing)。
随着中国业者走出中国之后，近年中国遭到美方337调查次数逐年增多。统计显示，自
2007年迄今美国发起的337调查中，涉及中国的案件几乎占70%，成为337调查最多的国家
。
本案，同一天，Tela Innovations同时于Delaware法院控告联想，也于北加州法院控告台
湾三家业者，而Tela Innovations与Intel之间专利纠纷，其实早于2018年5月就发生互控
事件。主要涉及5件系争专利：
10141334：Semiconductor chip including region having rectangular-shaped gate
structures and first-metal structures
10141335：Semiconductor CIP including region having rectangular-shaped gate
structures and first metal structures
7446352：Dynamic array architecture
7943966：Integrated circuit and associated layout with gate electrode level
portion including at least two complimentary transistor forming linear
conductive segments and at least one non-gate linear conductive segment
7948012：Semiconductor device having 1965 nm gate electrode level region
including at least four active linear conductive segments and at least one
non-gate linear conductive segment
