: 1. preamble 如果没有带给 body任何限制的话，不是有可能被认为没有专利权重吗?

: 当preamble的文字对整个claim而言是必要时，解释整个claim时就会
: 考虑到preamble...
: 例如 preamble的文字或元件有被引述到claim body中时，此时解释claim时
: 就无可避免的会考虑到preamble
: 以本案而言，若preamble的文字没有被引述到claim body，应该可视为没有
: 专利权重的一段文字吧，有必要发个112的核驳吗?

: 因为我觉得如果preamble只是要单纯解释claimed invention的用途的话

preamble跟body无关可能有几种
举个例子
1.一种摄像装置,能够拍摄一棵树,包含：
一镜头及一感光模组,
其中该镜头具有一含XX结构之镜片。
2.一种摄像装置,能够拍摄红外光影像,包含：
一镜头及一感光模组,
其中该镜头具有一含XX结构之镜片。
上面这两种
看到第一种我可能会问那棵树是什么鬼
不过第二种就不一定
因为那个XX结构可能跟红外光影像是有关的
也许是会滤除特定波长光线
而这个光线对红外光影像有特殊意义
这就要看说明书怎么讲
所以删不删还是看个案
审委发核驳可能只是要你说明一下
当然删掉也是一个选项
