However, the Secretary-General returned Taiwan’s application on 20 July 2007
without immediately placing the application before the representatives on the
Security Council, as required by rule 59 of the provisional rules of procedure
of the Security Council.
We respectfully stress that the Secretary-General’s response goes beyond his
prerogatives according to the sections of the Charter of the United Nations
and the rules aforementioned.
The Secretary-Generals unilateral determination that the United Nations
considers “Taiwan for all intents and purposes to be an integral part
of the People’s Republic of China” was a usurpation of the exclusive right
and obligation of the Security Council to make such determination pursuant
to rule 60 of the provisional rules of procedure of the Security Council,
which states: “The Security Council shall decide whether in its judgment the
applicant is a peace-loving State ...”

但是，秘书长于2007年7月20日退回了台湾的申请，而未按照安全理事会
暂行议事规则第59条的规定，立即将该申请提交安全理事会的代表。
恕我们直言，根据上述《联合国宪章》和规则的有关内容，秘书长的反应
超出了他的特权范围。秘书长单方面决定，联合国认为“就一切意图和目
的而言，台湾均是中华人民共和国不可分割的一部分”。这是在篡夺安全
理事会依据安全理事会暂行议事规则第60条作出此类决定的专有权利和义
务。
