小弟今年顺利抽到H1B，也已经Approved了并收到I-797B。
但是前公司不稳定所以在今年八月中用STEM OPT(07/2019到期)跳槽到新公司工作。
新公司的律师也file了新的H1B petition但是在两周前收到RFE，
律师在信件中提到RFE的理由是：
The sole issue raised by USCIS in the RFE is that because
you were only approved for an H-1B cap petition this year,
they contend that you haven't technically been "counted" against the cap yet.
USCIS has not been consistent in its adjudication with these types of cases
where the candidate changes employers before their status changes to H-1B.
根据我爬VISA版的文章，我的认知是我抽到了H1B并且Approved了，
那我就占有了这个名额，并不需要等到生效。
所以我有一些问题想问
1. 请问有详细的法规定义这种case吗？
2. 虽然新公司律师跟我确认这个对我的STEM OPT没有任何影响，
但是我想知道我的F1有可能在10/1因为H1B Change of Status被取消吗？
3. 如果F1有可能被取消，我现在需要马上联系前公司revoke我被approved的H1B吗？
