想请教前辈们一个关于TN VISA和I-140/485的关系的问题.
我目前正准备要递交I-140,稍后会递交I-485.
(律师会申请EB1, 先递交140, 通过后才递交485)
我太太应该会以配偶身份跟我一起申请绿卡.
但是同时, 我太太也有加拿大国籍(是无税务公民),
她正在找工作, 找到工作后会申请TN VISA.
理想的状态是: 她可以先用TN边工作, 一边等和我的绿卡申请.
但是我们遇到问题如下:
1.绿卡申请会不会影响到TN申请?
1.a 我丢I-140时, 会需要列我太太的名字吗?
还是只有在485时我太太的移民倾向才会曝光?
1.b 如果我先丢I-140出去后, 太太才找到工作, 这时候他还可以新申请TN VISA吗?
我听到两种说法:
(1)我问我的律师,回说:
"please note that listing your wife on the I-140OR petition (Form I-140)
will not negatively impact your wife's process. Also and most importantly,
please note that the AOS (Adjustment of Status, Form I-485) - the step
after the I-140OR petition has been approved - has not yet been initiated
and will not be initiated until after the I-140OR has been approved.
Moreover, once we are ready to initiate the AOS, you can - at that time -
speak with an Attorney regarding the overall process and the impact,
if any, it can have on you and your wife's status'."
意思是说I-140不会影响到, 我先丢. 等到丢I-485时才会有影响需要讨论.
(2)我在网络查到, 有人说丢了I-140, 已经申请到的TN不会失效,但是不能renew.
对照我们的状况是, 丢了I-140后才申请TN, 这样应该和renew一样是不行.
我不太确定哪一种说法是对的.
2.我太太是加拿大无税务公民, 这会影响到她的TN申请吗?
问题很细, 我查了很都资料还是没有看到明确的答案.
