You have a firearm in your possession while you are under the influence of
intoxicating liquor or of a controlled substance — a strict liability
offense. This means you don’t have to have intended to use the weapon or
have acted with any degree of legal culpability. Simply possessing a firearm
while intoxicated is a violation of Colorado’s law against prohibited use of
a weapon.

A first-time violation of CRS 18-12-106 is usually a class 1 misdemeanor in
Colorado. The punishment is:
Up to 364 days in jail, and/or
Up to $1,000 in fines
初犯者，会被认定是一级轻罪（轻罪中最重的），可处以最高364天的牢狱之灾
，然后最多被加罚一千美金。
五年之内再犯则是五级重罪，可处以一年到三年有期徒刑，另加罚一千到十万
美金。

依 Ja Morant 的影片，他本人“是否持有枪械”会需要更多证据（长得像枪
不代表就是枪，需要其他旁证），“是否饮酒”也需要更多证据；但只要两个
问题都是 Yes，那成立轻罪的可能性不小。
