法官今天宣判时说，土豪哥开毒趴，转让毒品与小模死没关系，依法医研究所鉴定，小模
体内PMA浓度高达3.778，连胃部都有，小模显然至少服毒4个月，而医学上浓度只要0.2就
会致死，但在场的土豪哥等人，体内都没这种毒，合议庭认定，小模死因与土豪哥开毒趴
及提供毒品无关，土豪哥不必为小模的死负责，但他开毒趴供毒，仍属违反药事法，判刑
2年10月。
依法医研究所分析显示，若在血液、胆汁及胃内采集到毒品反应，代表此人是短时间内服
用；如果是在头发化验出毒品反应，而且毒物反应还遍布头发，则显示当事人长期吃该项
毒品。而郭姓小模的头发被验出长达4公分遍布PMA、Ethylone这2种毒品，但她的肠胃或
血液却没有Ethylone这项毒品反应，显示郭姓小模吃Ethylone及PMA恐近半年，但在命案
现场可能没施用。
一审及二审都不采信土豪哥见解，全案上诉最高法院后，合议庭终于采信，并提出小模生
前曾看肾科，应查明是否肾有问题而无法及时排毒致死，将全案发回更审，高院更审认定
，小模死因，是自主行为介入致死，轻判土豪哥2年10月，仍可上诉。
